Terms of Service
These terms govern plot booking, allotment, payment, and ownership transfer with Mars Constech Ltd. Please read them before booking a plot or using this website.
Acceptance of these terms
By browsing marsconstech.com, submitting a booking form, or making any payment to Mars Constech Ltd ("the Company," "we," "us"), you ("the buyer," "you") agree to be bound by these Terms of Service and the plot allocation policy set out below. If you do not agree with any part of these terms, please do not proceed with a booking.
Plot booking eligibility
Any interested buyer may book a plot from our currently available inventory, subject to availability at the time of application. Plots are allocated in the order booking applications are received and approved.
Booking application & required documents
To book a plot, you must complete the official booking form and pay a booking deposit at the rate of BDT 1,00,000 per katha. The following must accompany your application:
- Two (2) recent passport-size photographs
- Two (2) copies of a valid National ID card (or passport, for foreign nationals)
Plot pricing
The price of each plot is determined by the Company's management committee based on location, size, and prevailing market conditions, and is subject to revision from time to time without prior notice. Prices confirmed in a signed booking agreement remain fixed for that booking.
Accepted payment methods
Booking money, down payments, and all installments must be paid through one of the following instruments, made payable to MARS CONSTECH LTD.:
- Cheque
- Demand Draft (DD)
- Telegraphic Transfer (TT)
- Pay Order
- Bank Draft
Payments from expatriate buyers
Buyers residing abroad may remit payment in foreign currency via Demand Draft, Telegraphic Transfer, Pay Order, Bank Draft, or other equivalent instruments, subject to applicable foreign exchange regulations in Bangladesh.
Development & utility charges
Development fees and charges for water, gas, electricity, and any other utility or service connection must be paid by the buyer at the rate determined by the Company at the relevant time.
Registration costs
All costs associated with registering the plot in the buyer's name are the buyer's responsibility, including but not limited to registration fees, stamp duty, VAT, gain tax, lawyer's fees, and any other statutory or incidental costs required under the Company's registration procedure.
Land development & government formalities
Buyers are responsible for pursuing, and bearing the cost of, any legitimate development activity and government mutation or land-record correction relevant to their plot, in coordination with the appropriate City Corporation, Union Parishad, Pourashava, or other competent authority.
Changing a booking
A change fee of BDT 20,000 applies to any request to change the details of an existing plot booking, subject to the Company's approval and operational feasibility.
Reallotment of paid amounts
If a buyer wishes to move funds already paid toward one plot onto a different plot, the Company reserves the right to set and apply the terms and any adjustment required for such division or reallotment.
Cancellation & refunds
Cancellation requests must be submitted in writing. Refunds are processed according to how soon the request is made after booking approval:
- Within 15 days of approval — a deduction of BDT 30,000 applies; the remaining balance is refunded within 45 days.
- After 15 days of approval — a deduction of 20% of the amount deposited applies; the remaining balance is refunded within 180 days.
Late payment & default
If an installment payment is delayed by more than 30 days, a late fee of 4% applies to the overdue amount. If a payment remains outstanding beyond 90 days, the Company may cancel the booking at its discretion.
Force majeure & transfer of allotment rights
In circumstances beyond the Company's reasonable control — including natural disaster, death of the buyer, or political instability — the buyer, or their legal heirs, may transfer their allotment rights to another party, subject to the Company's approval and any applicable transfer fee.
Amendments to these terms
The Company reserves the right to revise, update, or replace any part of these Terms of Service and the plot allocation policy at any time. Continued booking, payment, or use of this website after a revision constitutes acceptance of the updated terms. We encourage buyers to review this page periodically.
Website use & limitation of liability
Content on marsconstech.com, including plot listings, pricing, and imagery, is provided for general information and is subject to change without notice. It does not itself constitute a binding offer; a booking is only confirmed once the Company approves a completed booking application and receives the required deposit.
To the extent permitted by law, Mars Constech Ltd is not liable for indirect or consequential loss arising from use of this website. Nothing in these terms limits any right you have under the laws of Bangladesh. These terms are governed by, and construed in accordance with, the laws of Bangladesh, and any dispute is subject to the exclusive jurisdiction of the courts of Bangladesh.
